Item 1.04 Mine Safety - Reporting of Shutdowns and Patterns of Violations.
On July 21, 2010, the Dodd-Frank Wall Street and Consumer Protection Act (the “Act”) was enacted. Section 1503 of the Act requires a Current Report on Form 8-K if a company is issued an imminent danger order under Section 107(a) of the Federal Mine Safety and Health Act of 1977 (the “Mine Act”) by the federal Mine Safety and Health Administration (“MSHA”).
On July 20, 2021, Peabody Bear Run Mining, LLC, a subsidiary of Peabody Energy Corporation (the “Company”), received an imminent danger order under Section 107(a) of the Mine Act at the Bear Run surface mine located in Sullivan County, Indiana (the “Bear Run Mine”). An MSHA representative observed that a miner working 8 feet and 8 inches from the ground on the platform of a dozer was not wearing any fall protection and no handrails were provided. Bear Run Mine personnel promptly took appropriate actions to alleviate the condition. No injuries resulted from the condition.
